Know All Men by These Presents:
Whereas, on the day of June 1, 2010, judgment was rendered in the Circuit Court of the County of Franklin and State of Missouri, in favor of Richard Blackwell, and against William K. Wehmeyer, for the sum of seven hundred and fifth thousand dollars ($750,000) for damages, upon which judgment execution was issued from the Clerk's office of said Court in favor of the Plaintiff, and against the Defendant, dated the 25th day of August, 2010, directed to the Sheriff of the County of Crawford, and the same was delivered to me, Randy E. Martin, Sheriff of said County, on the 30th day of August, 2010, by virtue of which execution I, the Sheriff, did levy upon and seize all the right, title, interest and estate of the , of, in and to the following described parcels of real estate, situated in my County, to-wit:
PART OF LOTS 7 & 8 OF BOURDEAUX SUBDIVISION IN SULLIVAN, MISSOURI, MORE FULLY DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT 8; THENCE WITH LOT LINE NORTH 6˚ 35’ 25” EAST 93.69 FEET TO THE SOUTHWEST LINE OF STATE ROUTE “D” HIGHWAY; THENCE WITH SAME SOUTH 24˚ 32’ 42” EAST 103.76 FEET TO THE SOUTH LINE OF SAID LOT 8; THENCE LEAVING SAID HIGHWAY RIGHT-OF-WAY LINE NORTH 88˚ 36’04” WEST 53.87 FEET TO THE POINT OF BEGINNING.
THAT PART OF LOT NINE (9) OF BOURDEAUX SUBDIVISION, IN THE CITY OF SULLIVAN, COUNTY OF CRAWFORD, WHICH LIES WEST OF HIGHWAY “D”, AND BEING IN SECTION 17, TOWNSHIP 40 NORTH, RANGE 2 WEST. SUBJECT TO ANY EXISTING RECORDED EASEMENTS.
ALL OF THE WEST FOURTEEN (14) FEET OF LOT THREE (3), AND THE EAST FIFTY-SIX (56) FEET OF LOT FOUR (4) OF LUBBEN’S SUBDIVISION, IN SULLIVAN, MISSOURI, EXCEPT THAT PART PREVIOUSLY DEEDED TO THE MISSOURI STATE HIGHWAY COMMISSION RECORDED IN BOOK 262, PAGE 147 OF THE DEED RECORDS OF CRAWFORD COUNTY, MISSOURI.
And, whereas, having previously to the day of sale, hereinafter mentioned, given at least twenty (20) days' notice of the time and place of sale, and of the real estate to be sold, and where situated, as the law directs, by advertisement in the Sullivan Independent News, a newspaper published in my County, by virtue of which said execution and notice, I did, in accordance with that notice, on the day of 24th day of October, 2010, at the Court House door, in my County of Crawford, expose to sale at public auction for ready money, all the right, title, interest and estate of William K. Wehmeyer, of, in and to the above described real estate, and Richard Blackwell and The Smith Law Firm, LLC, being the highest and best bidder for that real estate at the price and sum of Dollars ($2,000), the same was struck off and sold to for that sum.
Now, Therefore, in consideration of the premises, and of the said sum of two thousand dollars ($2,000) to me, the Sheriff, in hand paid by Richard Blackwell and The Smith Law Firm, LLC, the receipt whereof I do hereby acknowledge, and by virtue of the authority in me vested by law, I, Randy E. Martin, Sheriff, do hereby assign, transfer and convey to Richard Blackwell and The Smith Law Firm, LLC, all the right, title, interest and estate of William K. Wehmeyer, in and to the above described real estate, that I might sell as Sheriff, by virtue of the aforesaid execution and notice.
To Have and to Hold the right, title, interest and estate hereby conveyed unto and his heirs and assigns, forever, with all the rights and appurtenances thereto belonging.
